Cannabis medicinal en San Juan

Argentina promulgó la ley 27.350 del uso medicinal de la planta de cannabis y sus derivados a través del Decreto 266/2017. Ya rige en el país, después de que el Senado aprobara en marzo una ley para que el Estado garantice el acceso al aceite de cannabis con fines terapéuticos.

Aunque la ley sancionada no habilita el autocultivo, significa un avance que venció resistencias de todo tipo gracias a la insistencia y militancia de un grupo de madres autodenominadas “Mamá cultiva”, a partir de allí, un grupo de mamás comenzaron a organizarse para que se dejara tratar con aceite de cannabis a sus hijos, en su mayoría enfermos con distintos tipos de epilepsia.

El cannabis medicinal, también conocido como marihuana médica, es el cannabis que tiene el fin de tratar o aliviar un síntoma, una dolencia o una enfermedad en lugar de propósitos recreativos o espirituales. Todo cannabis que contenga una cantidad efectiva de cannabinoides activos (es decir, que no sea cáñamo industrial) puede considerarse cannabis medicinal si se usa para dicho propósito.

QUE PERMITIRÍA LA NUEVA LEY:

  • El Estado garantizaría el acceso gratuito al aceite de cáñamo y demás derivados del cannabis a través del Programa Nacional para el Estudio y la Investigación del Uso Medicinal de la Planta de Cannabis, sus derivados y tratamientos no convencionales. Este organismo dependerá del ministerio de Salud y, entre sus tareas, deberá investigar las alternativas terapéuticas que no abordan los tratamientos médicos convencionales. Además, estará encargado de conocer los efectos secundarios y capacitar en esta área a los profesionales de la salud.
  • La Administración Nacional de Medicamentos, Alimentos y Tecnología Médica (ANMAT) permitirá la importación de aceite de cannabis y sus derivados a los pacientes que presenten las patologías contempladas en el programa y tengan la indicación médica correspondiente. Para ellos, la provisión será gratuita.
  • El Ministerio de Salud podrá autorizar el cultivo de cannabis por parte del Conicet y el INTA, para hacer estudios médicos y científicos y elaborar la sustancia para el tratamiento que suministrará el programa. Por el momento, la droga será importada desde los Estados Unidos.
  •   Se creará un registro nacional para pacientes y familiares y sus datos serán confidenciales.
  • También, se instalará un consejo consultivo integrado por asociaciones, organizaciones no gubernamentales y profesionales del sector público y privado.
  • Los laboratorios de Producción Pública de Medicamentos podrán producir cannabis en todas sus variedades para su uso medicinal, terapéutico y de investigación.
